Course Description:

The purpose of this course is to convey a broad understanding of the structure and content of Public Law in Canada, and an introductory understanding of the Charter. The Fall semester of the primarily focuses on the basic principles of public law and examines the structure of the Canadian legal system, the legal system’s constitutional basis, and the Canadian court system, including the role of courts in overseeing legislative action. The Fall semester may also include an introduction to the Canadian Charter of Rights and Freedoms (Charter), but deeper exploration of selected Charter rights and freedoms, as well as judicial reasoning under the Charter, is usually reserved for the Winter semester. The goal is for students to gain a basic understanding of the key issues in these areas and to develop their ability to critically analyze evolving public/constitutional jurisprudence. The dominant theme in this course is the exercise of “power”: who exercises it, how it is exercised, and when it is appropriate for courts to supervise and constrain the exercise of power.

Requirements:

The Common Law Section is seeking candidates who are leaders in the legal profession. An LL.B., J.D., or equivalent is required for this position. Membership in the Law Society of Ontario, or equivalent, in good standing is also required. The successful candidate will have significant experience in public and constitutional law. Prior teaching experience will be considered an asset. The Introduction to Public & Constitutional Law course will be offered in person.

The Common Law Section reserves the right to select a candidate who does not fully meet each of these requirements, where the candidate’s selection would be beneficial to the program, the course, the students or for a related reason.

The candidate may be required to teach this course either online, in-person or hybrid mode at the discretion of the Faculty and in accordance with public health guidelines.
